  • Climate Control: You must have cooling systems installed and operational in all bedrooms and living areas from May to August. Heating must be provided from November to March. Fans do not cut it anymore.
  • Space Limits: The law now mandates a minimum of 14 m² of space per occupant, with the absolute minimum size of any holiday rental set at 25 m².
  • The Bathroom Rule: If your property sleep five or more guests, you are legally required to provide at least two bathrooms.

If your property does not meet these criteria, you risk heavy administrative fines or losing your tourist licence altogether. The decree also explicitly highlights the role of professional management companies (empresas explotadoras) to ensure these standards are met and guest rights are protected.

Keeping Peace with the Neighbours

Under Spain's Horizontal Property Law (Ley de Propiedad Horizontal, Article 17.12), local communities of owners (Comunidades de Propietarios) can ban or restrict holiday rentals within their buildings with a 3/5ths majority vote. Town halls across Malaga, Estepona, and Marbella are also tightening zoning rules for new licences.

If your guests are noisy, leave rubbish in the common areas, or cause disruption, your neighbours have the legal power to shut your business down.
