What owners in Benalmádena need to know
The town's first housing study, presented in February 2026, counts 8,209 tourist homes as of October 2025: 17% of all homes in the municipality. 85% are on the coast and only half are actually active.
The study proposes ceilings by area — 5–8% in Benalmádena Pueblo (8% today), 5% in Arroyo de la Miel (4% today) and 16% on the coast (16.6% today) — but they are recommendations: we have found no decision adopting them.
Check your community's statutes. In 2025 and 2026 Spain's registry authority (DGSJFP) ruled on several appeals against Benalmádena Property Registry no. 2: if a ban on tourist lets was registered before you bought, the national registration number is refused; if it was agreed but only registered after your purchase, it does not bind you.
In regulated tourist apartments, occupancy per unit was 87.1% in July 2025 and 41.7% in January (INE).
