What owners in Marbella need to know
In February 2025 the town hall announced a municipal register of holiday lets and a bylaw to stop commercial premises being converted into tourist homes. We have found no approval or publication of either in the provincial gazette, and no freeze on new registrations like Málaga city's.
A University of Málaga study presented by the town hall found that only 32% of the tourist homes registered in Marbella are actually being marketed. The sector turned over €100 million in 2024, and average guest spending, €173, is double the provincial average.
Spain's national rental register is weeding listings out: by 2 February 2026 the Housing Ministry had refused 2,993 applications in Marbella, one of the highest figures in the country, and asked Airbnb and Booking to take illegal listings down.
Marbella is more seasonal than Málaga or Torremolinos: in regulated tourist apartments, occupancy per unit was 71.1% in August 2025 and 36.4% in December (INE). Here the low season and mid-term stays carry real weight in your annual result.

Marbella has 15,798 homes holding a tourist licence and only 6,987 listed on Airbnb, Booking or Vrbo. If you hold a licence and are not using it, that is a stalled asset — and since 2026 a new one is much harder to get.
